NCCC Survey: Rescheduling and DEA Registration

On April 22, 2026, the U.S. Department of Justice issued an order moving state-licensed medical marijuana from Schedule I to Schedule III of the Controlled Substances Act. At the same time, the order created an opportunity for state-licensed medical marijuana businesses to apply directly with DEA for registration as a federally-authorized operator, and further established a 60-day priority application window for these registrations. This priority registration window has now closed as of June 26, 2026.

With the priority registration window closed, policymakers, businesses, and the public are lacking answers to crucial questions: what proportion of state-licensed businesses applied for registration? How many have been approved or denied? For businesses which did not apply, why didn’t they apply?

The goal of this survey is to collect this information to better understand the accessibility of the DEA registration process for state-licensed businesses. The survey is anonymous, but includes questions regarding your business type, size, and regional location in order to better understand how different types of businesses are responding to the rescheduling order. We expect the survey to take less than 5 minutes to complete. Once completed, NCCC will publish the aggregate results of the survey.
